The Ministry of Agriculture, Livestock and Supply (Mapa) defined the rules regarding the deadlines and procedures to be observed by producers at the time of reporting claims and by insurers in scheduling surveys, under the Rural Insurance Premium Grant Program (PSR). The PSR assists the producer in the acquisition of rural insurance, paying part of the value of the policy (premium), in the agricultural, livestock, aquaculture and forest modalities.
According to the director of the Department of Risk Management of the Map, Pedro Loyola, Resolution No. 73, of the Interministerial Management Committee of Rural Insurance, regulates a procedure that had no standard of deadlines for producers and insurers, bringing greater efficiency in the attendance to claims statements of producers and better allocation of technicians in the scheduling of field surveys.
"With this, it will no longer be possible to admit cases of untimely warnings of losses by producers in case of climate adversities and other risks covered in the policy and insurance companies have standardized rules for scheduling field surveys, according to the situations provided for in the resolutions," he said.
In the policies benefited by the PSR, the following deadlines should be adopted regarding the occurrence of claims:
I- By rural producers: in the event(s) covered, the insured by himself, or by his legal representative or agent, under penalty of losing the direct to indemnity, must communicate the fact to the insurer, through the communication channel of the respective company, as soon as he knows the event occurred, respecting the deadline in days, as specified below:
a) Maximum period of 8 (eight) calendar days, from the date of occurrence of the event, for the coverage of: excessive rain in the harvest, frost, hail, fire/lightning, flood, excessive temperature variation, cold winds and strong/gale winds.
b) For drought and excessive rain cover, a maximum period of 5 (five) calendar days from the end of the dry or rainy period, still limited to 30 (thirty) calendar days from the beginning of the harvest.
II – By the insurers: upon receipt of the claim notice, the insurer will send the expert within:
a) For Preliminary Inspection – 20 (twenty) calendar days from the notice of accident.
b) For Final Survey – The scheduling of the final survey will be agreed between the expert and the insured. This schedule will follow the date contained in the harvest notice, which must be informed by the insured within a maximum of 15 (fifteen) days before the harvest.
In addition, if there are events with catastrophic characteristics, whether climatic with high severity and frequency, or any others that may interfere with the deadlines and conditions for conducting the surveys, the deadline for sending the preliminary survey may be changed. The new deadline should be defined in common agreement between insurer and insured.
